What is personal, sensitive & confidential information?

Personal information is any fact or option that reveals the identity of an individual, whether apparent, or readily ascertainable from that information. Sensitive information about an individual relates to their private affairs including, but not limited to political, religious, sexual and medical circumstance.

Bekkers treats all information provide to us by our clients, prospective clients, employees, and business associates as in-confidence; whether personal, sensitive, or relating to their business affairs. Confidential information does not need to be explicitly marked as such to be confidential. Common law holds that when information is imparted to a confidant, then whether express or implied that information is confidential, and failure to maintain that confidence is a breach of confidence. We ensure that our practises and employees are bound by agreement to this duty.

Protection, Use and Disclose of Personal Information

Bekkers imposes all reasonable physical, and electronic measures to protect personal information collected as we do with our own business affairs.

In accordance with privacy statues and equitable duties of confidence, we are permitted to use and disclose personal, and sensitive information only for the purpose for which it was provided. We always seek consent prior to providing personal information to other service providers, or vendors when acting on your behalf. We will use personal contact information for direct marketing, but will always provide the option to opt out.

Instances where we will disclose information without your consent are limited to situations where we are compelled to by law, when cooperating with reasonable law enforcement requests, and disclosing information to credit reporting agencies.
